By engaging the services of Artech Concepts (“Service Provider”) and/or using the Artech Concepts website (www.artechconcepts.com), you (“Client”) agree to the following Terms and Conditions. These terms apply to all projects, services, and use of the Website as specified in corresponding invoices, proposals, or service orders.
1. SCOPE OF SERVICES
The Service Provider offers professional services including, but not limited to:
• Branding & Brand Identity
• Graphic Design
• Marketing & Promotional Materials
• Web Design & Web Content Creation
• SEO (Search Engine Optimization)
• GEO (Generative Engine Optimization)
• ADA Accessibility Services
• Digital Business Cards (eCards)
• Privacy Policies & Legal Website Setup
• Printing & Packaging Design
• Video & Audio Content Creation
• Keynote Presentations & Pitch Decks
• Digital solutions tailored to the Client’s needs
Only services explicitly listed in a written proposal, invoice, or agreement are included. Any additional services requested by the Client may require separate approval and may incur additional fees.
2. AUTHORIZATION FOR EXTERNAL SERVICES
For website and digital projects, the Client authorizes Artech Concepts to:
• Acquire domain names, hosting services, website-building services, or third-party platforms such as Wix or similar providers
• Purchase and configure third-party services under the Client’s name when required
• Configure integrations, accessibility tools, SEO tools, analytics systems, or related digital services necessary for project implementation
Upon project completion:
• Administrative access credentials for domains, hosting, and related services will be transferred to the Client when applicable
• Ownership and control of third-party services will remain under the Client’s responsibility, including renewals, upgrades, subscriptions, and cancellations
Unless otherwise agreed in writing, the Client assumes full responsibility for ongoing maintenance, renewals, subscriptions, and associated operational expenses.
2.1 WIX PAYMENTS, RENEWALS & RECONNECTION FEES
Payments for Wix services, domains, hosting, and related third-party platforms are separate from the agreement with Artech Concepts.
Artech Concepts acts solely as an authorized intermediary to assist with setup, configuration, and payment processing when requested by the Client.
The Client is solely responsible for ensuring timely renewals of domains, hosting, subscriptions, and related services.
If a website or related service becomes suspended due to non-payment, expired subscriptions, or failed renewals, the Client must pay all outstanding fees directly to the provider. Artech Concepts reserves the right to charge a minimum reconnection or reactivation fee of $50.00 USD to restore services.
3. WEBSITE ACCESS & THIRD-PARTY LINKS
Access to the Artech Concepts Website is provided on a temporary basis. Artech Concepts reserves the right to modify, suspend, discontinue, or update the Website or any services without prior notice.
The Website may contain links to third-party websites or services not owned or controlled by Artech Concepts. The Service Provider assumes no responsibility for external websites, content, policies, or practices. Use of third-party platforms is at the Client’s own risk.
4. WEB ACCESSIBILITY & ADA COMPLIANCE
The Client acknowledges that ADA / Web Accessibility compliance is not included unless explicitly contracted as a separate service.
The Client understands and agrees that compliance with the Americans with Disabilities Act (ADA), WCAG standards, Section 508, or any other federal, state, or local accessibility regulation is ultimately the Client’s responsibility.
The Client assumes full responsibility for website accessibility compliance, including audits, remediation, updates, monitoring, and any legal claims or actions arising from alleged non-compliance.
ADA COMPLIANCE DISCLAIMER
Artech Concepts provides accessibility-related services intended to assist Clients in improving website usability and accessibility in alignment with recognized standards such as WCAG 2.1/2.2.
However, the Client acknowledges and agrees that:
• Artech Concepts does not guarantee full compliance with ADA, Section 508, WCAG standards, or any other legal regulation
Accessibility compliance is an ongoing process that may require continuous updates, monitoring, and manual remediation
• The implementation of third-party tools, including but not limited to accessiBe, does not guarantee immunity from legal claims, lawsuits, or regulatory actions
• Artech Concepts shall not be held liable for accessibility-related claims, damages, penalties, or legal actions
• The Client is solely responsible for obtaining independent legal advice regarding accessibility obligations and compliance requirements
INDEMNIFICATION CLAUSE (ACCESSIBILITY SERVICES)
The Client agrees to indemnify, defend, and hold harmless Artech Concepts from and against any claims, liabilities, damages, losses, legal expenses, or actions arising from website accessibility compliance or alleged accessibility violations.
4.1 SEO, GEO & DIGITAL VISIBILITY DISCLAIMER
The Client acknowledges that SEO (Search Engine Optimization), GEO (Generative Engine Optimization), and digital visibility services are strategic processes influenced by search engine algorithms, AI systems, market competition, user behavior, and evolving digital trends.
Artech Concepts does not guarantee specific rankings, traffic levels, AI recommendations, search engine placement, lead generation results, or business performance outcomes.
SEO and GEO performance may vary depending on competition, market conditions, website quality, platform limitations, content structure, and ongoing optimization efforts.
4.2 AI GENERATED CONTENT & TECHNOLOGY DISCLAIMER
The Client acknowledges that certain services provided by Artech Concepts may involve the use of artificial intelligence (AI), generative technologies, automation tools, or third-party AI-powered platforms.
While Artech Concepts reviews and refines generated materials whenever applicable, AI-generated content may require additional human review, editing, legal evaluation, or verification prior to publication or commercial use.
Artech Concepts shall not be held liable for inaccuracies, copyright disputes, platform limitations, AI-related errors, or unintended outcomes associated with AI-generated content or technologies.
5. ORDERS & SPECIFICATIONS
To ensure efficient project execution:
• Orders must be complete, detailed, and submitted through a single communication channel whenever possible
• Missing, unclear, or incorrect information must be clarified by the Client before project execution
• Delays caused by incomplete information or lack of communication are the Client’s responsibility
6. PAYMENT TERMS
Unless otherwise agreed in writing, all services provided by Artech Concepts are billed and payable in advance prior to the start of work, project delivery, activation of services, or release of final files.
Artech Concepts reserves the right to require full or partial upfront payment depending on the scope, complexity, timeline, or nature of the project.
A separate invoice may be issued for each project, service, subscription, maintenance plan, or additional request.
Payment constitutes acceptance of these Terms and Conditions and authorization for Artech Concepts to begin work related to the approved service.
Artech Concepts reserves the right to pause, delay, suspend, or withhold services, deliverables, website access, or project releases if payment obligations are not fulfilled.
Late payments may result in delayed timelines, interrupted services, temporary suspension of projects, or restricted access to deliverables until balances are resolved.
Artech Concepts reserves the right to charge reasonable late fees, reconnection fees, reactivation costs, or administrative fees associated with overdue accounts.
Artech Concepts is not obligated to release final deliverables, transfer website ownership, publish websites, or provide administrative access until all outstanding balances have been paid in full.
7. REVISIONS & MODIFICATIONS
Clients may request revisions within the timeframe specified in the project agreement.
• Minor revisions will be completed within a reasonable timeframe
• Significant changes affecting project scope, complexity, structure, or timelines may incur additional fees
Artech Concepts reserves the right to:
• Charge for additional work required beyond the original scope
• Decline excessive revisions
• Issue partial refunds only for unused portions of services when applicable
8. PROJECT DELAYS, CLIENT INACTIVITY & FINAL APPROVAL
Timely communication and feedback are essential for project completion.
If a project is delayed due to the Client’s failure to provide feedback, approvals, revisions, content, or instructions within thirty (30) business days from the date requested, the project may be considered completed and administratively closed based on the latest approved version.
Any revisions or updates requested after the thirty (30) business day period may be treated as a new service subject to additional fees and updated timelines.
Lack of communication exceeding thirty (30) business days constitutes acceptance of work completed to date.
9. INTELLECTUAL PROPERTY
Upon full payment, ownership of final approved deliverables transfers to the Client unless otherwise stated in writing.
All intellectual property rights related to the Artech Concepts Website, templates, internal systems, branding, proprietary processes, and original content remain the property of Artech Concepts.
Artech Concepts retains the right to display completed work in portfolios, marketing materials, presentations, and promotional content unless otherwise agreed in writing.
9.1 CLIENT CONTENT RESPONSIBILITY
The Client represents and warrants that all content, images, logos, trademarks, media, text, and materials provided to Artech Concepts are owned by the Client or properly licensed for commercial use.
The Client assumes full responsibility for copyright claims, trademark disputes, licensing violations, or legal issues associated with Client-provided materials.
Artech Concepts shall not be held liable for unauthorized, infringing, or improperly licensed content supplied by the Client.
10. LIABILITY & INDEMNIFICATION
The Client agrees to release and hold harmless Artech Concepts from any claims, damages, losses, liabilities, or expenses arising from the use of services, websites, content, platforms, or third-party integrations.
Artech Concepts shall not be liable for indirect, incidental, consequential, punitive, or business-related damages, including loss of revenue, profits, data, visibility, rankings, or business interruption.
The Client agrees to indemnify and defend Artech Concepts against liabilities, legal claims, damages, expenses, or actions resulting from misuse of services, failure to comply with regulations, or unauthorized content.
In no event shall Artech Concepts’ total liability exceed the total amount paid by the Client for the specific service giving rise to the claim.
10.1 THIRD-PARTY PLATFORM DISCLAIMER
Artech Concepts may utilize third-party services, software, hosting providers, plugins, accessibility tools, AI technologies, payment processors, analytics systems, or external applications as part of its services.
Artech Concepts is not responsible for outages, security issues, pricing changes, algorithm updates, discontinued services, technical limitations, policy changes, or operational failures associated with third-party providers.
11. PRIVACY POLICY
Artech Concepts’ Privacy Policy explains how personal information is collected, used, stored, and protected.
By using the Website or engaging services, the Client consents to the practices described in the Privacy Policy.

12. TERMINATION
Either party may terminate a project agreement with written notice.
The Client will remain responsible for payment of all completed work, active services, purchased assets, subscriptions, or outstanding balances incurred prior to termination.
Payments made are non-refundable unless otherwise stated in writing.
12.1 FORCE MAJEURE
Artech Concepts shall not be held liable for delays, interruptions, failures, or damages caused by circumstances beyond reasonable control, including but not limited to natural disasters, cyberattacks, internet outages, platform failures, governmental actions, labor shortages, AI service interruptions, or third-party service disruptions.
13. GOVERNING LAW & DISPUTE RESOLUTION
These Terms and Conditions shall be governed and interpreted under the laws of the State of California.
Any dispute arising from these Terms or related services shall first be attempted to be resolved through good-faith negotiations between both parties prior to formal legal action.
14. ACCEPTANCE OF TERMS
By submitting payment, engaging services, signing proposals, approving invoices, or accessing the Website, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
This acknowledgment constitutes a legally binding agreement between the Client and Artech Concepts.
