Acuerdo de Servicios Digitales
Effective Date: March 2026
By engaging the services of Artech Concepts (“Service Provider”) and/or using the Artech Concepts website at www.artechconcepts.com, you (“Client”) agree to the following Digital Services Agreement, which applies to all projects, quotations, invoices, proposals, consultations, maintenance plans, subscriptions, and service orders issued by Artech Concepts.
1. SCOPE OF SERVICES
Artech Concepts provides customized digital solutions and professional creative services including, but not limited to:
• Branding & Brand Identity
• Logo Design
• Graphic Design
• Marketing & Promotional Materials
• Website Design & Development
• SEO (Search Engine Optimization)
• GEO (Generative Engine Optimization)
• ADA Accessibility Services
• Privacy Policies & Legal Website Setup
• Digital Business Cards (eCards)
• Video & Audio Content Creation
• Keynote Presentations & Pitch Decks
• Printing & Packaging Design
• Website Maintenance & Optimization
All services are customized according to the Client’s approved proposal, invoice, quotation, or written agreement.
Any service not explicitly included in writing shall be considered outside the project scope and may require additional fees.
2. AUTHORIZATION FOR EXTERNAL SERVICES
For website and digital projects, the Client authorizes Artech Concepts to:
• Acquire, configure, and manage domains, hosting services, Wix plans, and third-party platforms when necessary
• Configure integrations, accessibility tools, SEO tools, analytics systems, cookies banners, or related digital technologies
• Purchase third-party services on behalf of the Client when required for proper project functionality
• Upon project completion:
• Administrative credentials and access information may be transferred to the Client when applicable
• Ownership of domains, hosting accounts, subscriptions, and third-party services shall remain the Client’s responsibility
The Client assumes full responsibility for all renewals, upgrades, maintenance costs, subscriptions, and operational expenses associated with third-party services unless otherwise agreed in writing.
2.1 WIX PAYMENTS, RENEWALS & REACTIVATION FEES
Payments related to Wix services, hosting, domains, subscriptions, or external platforms are separate from this Agreement.
Artech Concepts acts solely as an authorized intermediary assisting with setup, configuration, and initial payment processing on the Client’s behalf.
The Client is solely responsible for maintaining active renewals of:
• Wix plans
• Domains
• Hosting services
• Connected subscriptions
• Third-party applications or integrations
If services become suspended, expired, disconnected, or inaccessible due to non-payment or failed renewals, the Client shall be responsible for:
• All renewal and reactivation costs charged by third-party providers
• A minimum reactivation or reconnection fee of $100.00 USD payable to Artech Concepts before services resume
3. WEBSITE ACCESS & THIRD-PARTY PLATFORMS
Access to the Artech Concepts Website and related services is provided on a temporary and non-guaranteed basis.
Artech Concepts reserves the right to modify, suspend, update, restrict, or discontinue website access, services, or features without prior notice.
Websites and digital services may rely on third-party platforms, providers, plugins, accessibility tools, AI technologies, analytics systems, hosting providers, or external integrations beyond the control of Artech Concepts.
Artech Concepts shall not be held responsible for outages, pricing changes, policy modifications, discontinued features, technical limitations, security issues, algorithm changes, or failures caused by third-party providers.
4. ADA ACCESSIBILITY & COMPLIANCE
ADA / Web Accessibility compliance is not included unless explicitly contracted as a separate service.
The Client acknowledges that compliance with ADA, WCAG standards, Section 508, or other federal, state, or local accessibility regulations is ultimately the Client’s responsibility.
Artech Concepts may provide accessibility-related services intended to improve website usability and accessibility; however:
• No accessibility solution guarantees full legal compliance
• Accessibility compliance is an ongoing process requiring continuous monitoring and updates
• Third-party accessibility tools, including but not limited to accessiBe, do not guarantee immunity from claims or lawsuits
The Client assumes full responsibility for website accessibility compliance and agrees to seek independent legal advice regarding accessibility obligations.
4.1 SEO, GEO & DIGITAL VISIBILITY DISCLAIMER
The Client acknowledges that SEO (Search Engine Optimization), GEO (Generative Engine Optimization), and digital visibility services are strategic processes influenced by search engine algorithms, AI systems, user behavior, competition, and evolving digital technologies.
• Artech Concepts does not guarantee:
• Specific search rankings
• Traffic levels
• AI recommendations
• Search engine placement
• Lead generation results
Revenue growth or business performance outcomes
SEO and GEO performance may vary depending on market conditions, competition, content quality, technical factors, and ongoing optimization efforts.
4.2 AI GENERATED CONTENT & TECHNOLOGY DISCLAIMER
Certain services provided by Artech Concepts may involve the use of artificial intelligence (AI), automation systems, generative technologies, or AI-powered platforms.
AI-generated content, recommendations, media, or outputs may require additional review, editing, legal evaluation, or verification before publication or commercial use.
Artech Concepts shall not be held liable for inaccuracies, copyright disputes, platform limitations, AI-related errors, or unintended outcomes associated with AI-generated materials or technologies.
5. ORDERS & PROJECT SPECIFICATIONS
To ensure efficient service delivery:
• All project requests must be complete, detailed, and submitted through a primary communication channel whenever possible
• Missing or unclear information must be clarified before project execution
• Delays caused by incomplete information, lack of communication, or late approvals are the Client’s responsibility
Each project, phase, subscription, or service may be invoiced separately.
6. PAYMENT TERMS
Unless otherwise agreed in writing, all services provided by Artech Concepts are billed and payable in advance prior to the start of work, activation of services, publication of websites, or release of final deliverables.
Projects approved under installment payment arrangements must follow the payment schedule established in the invoice or written agreement.
• Failure to complete two consecutive payments may result in:
• Suspension of services
• Restricted website access
• Removal of maintenance or support
• Delayed project delivery
Temporary deactivation of website-related services
Artech Concepts reserves the right to pause, delay, suspend, or withhold deliverables, website access, transfers, or project releases until all outstanding balances are paid in full.
Late payments may result in administrative fees, reconnection fees, reactivation costs, or additional service charges.
Any payment made constitutes acceptance of this Agreement.
7. REVISIONS & MODIFICATIONS
The Client may request revisions within the timeframe specified in the approved project agreement.
Minor revisions may be completed within a reasonable timeframe.
Significant revisions, structural changes, redesign requests, or modifications affecting scope, functionality, or timelines may incur additional fees.
Artech Concepts reserves the right to:
• Decline excessive revisions outside the agreed scope
• Charge additional fees for expanded work
• Establish updated timelines for modified deliverables
8. PROJECT DELAYS, CLIENT INACTIVITY & FINAL APPROVAL
Timely communication and approvals are essential for project completion.
If a project remains inactive due to lack of Client communication, approvals, revisions, content, or instructions for more than thirty (30) business days, Artech Concepts reserves the right to consider the project administratively completed using the latest approved version.
Requests submitted after the inactivity period may require:
• New agreements
• Additional fees
• Revised timelines
Lack of communication exceeding thirty (30) business days constitutes acceptance of work completed to date.
9. INTELLECTUAL PROPERTY
Ownership of final approved deliverables transfers to the Client only after full payment has been received.
Until all outstanding balances are resolved, Artech Concepts retains ownership rights over all work, designs, structures, drafts, concepts, and deliverables.
• Artech Concepts retains ownership of:
• Proprietary systems
• Templates
• Internal methodologies
• Design frameworks
• Website structures
• Custom processes and non-transferable assets
Artech Concepts reserves the right to display completed work in portfolios, presentations, marketing materials, and promotional content unless otherwise agreed in writing.
9.1 CLIENT CONTENT RESPONSIBILITY
The Client represents and warrants that all materials provided to Artech Concepts, including text, logos, images, trademarks, videos, media, or content, are owned by the Client or properly licensed for use.
The Client assumes full responsibility for copyright claims, licensing disputes, trademark conflicts, or legal issues associated with Client-provided materials.
Artech Concepts shall not be liable for unauthorized, infringing, or improperly licensed content supplied by the Client.
10. LIABILITY & INDEMNIFICATION
The Client agrees to release, indemnify, defend, and hold harmless Artech Concepts from any claims, liabilities, losses, damages, penalties, legal expenses, or disputes arising from:
• Use of services or websites
• Accessibility-related claims
• SEO or GEO performance
• Third-party integrations
• Client-provided content
• Regulatory non-compliance
• Misuse of services
Artech Concepts shall not be liable for indirect, incidental, consequential, punitive, or business-related damages, including loss of revenue, visibility, rankings, business opportunities, or operational interruption.
In no event shall Artech Concepts’ total liability exceed the total amount paid by the Client for the specific service giving rise to the claim.
11. PRIVACY POLICY
Artech Concepts processes personal information according to its Privacy Policy available at:

By using the Website or engaging services, the Client consents to the practices described within the Privacy Policy.
12. TERMINATION
Either party may terminate this Agreement through written notice.
The Client remains responsible for payment of:
• Completed work
• Active subscriptions
• Purchased assets
• Outstanding balances
• Third-party expenses incurred prior to termination
No ownership transfers, website publications, final files, or administrative credentials shall be released until all outstanding balances are fully paid.
Payments made are non-refundable unless otherwise stated in writing.
12.1 FORCE MAJEURE
Artech Concepts shall not be held liable for delays, interruptions, or failures caused by circumstances beyond reasonable control, including but not limited to natural disasters, internet outages, cyberattacks, platform failures, AI service interruptions, governmental actions, labor shortages, or third-party service disruptions.
13. GOVERNING LAW & DISPUTE RESOLUTION
This Agreement shall be governed by the laws of the State of California.
Any disputes arising from this Agreement shall first be attempted to be resolved through good-faith negotiations between both parties prior to formal legal proceedings.
14. ACCEPTANCE OF AGREEMENT
By making payment, approving proposals, engaging services, signing invoices, or using the Website, the Client acknowledges having read, understood, and agreed to this Digital Services Agreement.
This acknowledgment constitutes a legally binding agreement between the Client and Artech Concepts.
